1. Commercial Policy
1.1 The "seller" Typical Morning Unipessoal LDA (Toh) offers products for sale on the website toh.pet, with "ecommerce" services available exclusively for end users/“consumers.”
1.2 The "Consumer" refers to the individual who acts/buys outside their business or profession. If you are not a "Consumer," we request that you do not make purchases on the online store toh.pet.
1.3 Typical Morning Unipessoal LDA reserves the right not to process orders received from users who are not "Consumers" or those that do not comply with the general sales conditions of the seller Typical Morning Unipessoal LDA.
1.4 These general terms and conditions exclusively govern the offer, transmission, and acceptance of orders placed on toh.pet between the online store consumers of Toh (toh.pet) and the seller.
1.5 The "Consumer" must provide the "Seller" with a correct and complete email address or contact information and agrees that the "Seller" may contact them using these details, if deemed necessary.
2. How to Order
2.1 To order on toh.pet, the user must have an email account and have their browser configured to accept cookies and pop-ups, allowing full navigation of the Toh online store.
Ordering from the Toh Online Store is easy:
Find the products you wish to purchase;
Add the selected products to the Cart;
Complete the purchase;
Select the payment option;
Review your order;
Proceed to payment and confirm the order;
You will receive an order confirmation by email;
Your order is confirmed when you select the “Confirm Payment” (Checkout) button at the end of the purchasing process.
When Toh receives your order, a message with your order number and all details will appear on the screen. The purchase agreement is finalized at that moment.
An order confirmation will be sent to your email. We suggest you print or download this copy for future reference.
We reserve the right not to accept your order or to cancel it even after automatic confirmation.
By submitting the order form, you are accepting the general purchasing conditions, as well as other conditions found on toh.pet via links, including the general terms of use.
The seller may not process orders that do not have sufficient guarantee of proper payment; when orders are incomplete or incorrect, or if the ordered products are no longer available. In these cases, we will inform you by email that the sales contract was not completed and that the seller did not proceed with the sale, specifying the reasons for this.
If the products shown in the online store (toh.pet) are no longer available at the time of your last access or when the seller receives the order, the seller will inform you of their unavailability within 30 days of receiving the order.
If an order and payment have been made for products that are no longer available, the seller will proceed with a refund for the unavailable items.
2.2 Right to Refuse an Order or Cancel a Purchase
Toh reserves the right to refuse any order for any reason. We also reserve the right to cancel any purchase (even if it has already been accepted by us), including but not limited to the following situations, without liability for any damages or costs:
The product is no longer available/in stock (payments will be refunded);
Billing information is incorrect or unverifiable;
The order is flagged by our Security Systems as incorrect or possibly fraudulent;
The payment transfer for the order was not received by us within 5 days after accepting your order;
If we believe you are under 16 years old;
If we believe you are a reseller;
If delivery to the provided address is not possible.
2.3 Data Verification
After receiving the order, we may perform some checks on it before preparing it.
These checks may include address verification, credibility, and fraud checks. Regarding fraud verification, we conduct partially automated checks on all orders to filter out unusual, suspicious, or potentially fraudulent transactions. Fraud suspicions will be investigated and, if necessary, processed. By confirming your order, you agree to these conditions.
3. Product Warranty and Price Indication
3.1 Payment Methods
You can find the available payment methods in the Help/FAQ section of the website. We do not accept any other payment method besides those mentioned. Please do not attempt to pay through any other means not specified. If you do, we cannot be held responsible for loss of payment or any other damages that may arise.
3.2 Payment Processing
If you pay by Credit Card, the amount due will be deducted from your account as soon as your order leaves our warehouse. In the case of Credit Card payment, all details (e.g., card number or expiration date) will be sent via encrypted protocol to the company providing remote electronic payment services, with no third-party access to the transmitted information.
This information will only be used by Toh for necessary procedures for the purchase or refund in the event of a return, in accordance with the right of return, or for communication with the police in case of fraud.
The purchase price of the products and the shipping costs, as indicated in the order form, will be charged to the current account when the purchased products are actually shipped.
4. Order Security
4.1 The toh.pet store uses some of the most robust security technology among available encryption platforms.
Your payment information will be encrypted from the moment you enter it until the transaction is processed and will not be stored on a public server. Although we use encryption software, the security of information and payments transmitted over the internet or via email cannot be guaranteed.
Toh cannot be held responsible for any damage suffered as a result of using electronic communication means, including but not limited to damages resulting from failures or delays in electronic communications delivery, interceptions or tampering with electronic communications by third parties, or computer programs used for communications or virus transmissions.
If you choose payment via Multibanco Reference, we will start processing the order once we have received the payment. This may take several days. After 3 calendar days from placing the order, if no payment is received, Toh has the right to cancel the order.
Payments can only be processed if the billing information can be verified.
5. Ownership Reservation
Toh retains ownership of the products until full payment has been received for all those products.
6. Prices
6.1 The prices of the products displayed on the website include VAT. Shipping fees are applied per order. The exact shipping cost will depend on the country where your order is delivered. For additional information on shipping fees by country, refer to the Help/FAQ section of the website.
6.2 Prices are quoted in euros. Please note that changing the delivery country may affect the prices due to shipping costs.
6.3 Your Total Price
The total price specified at the final checkout menu includes taxes and shipping costs. The prices are quoted when the order is confirmed, which you can print or download for future use. Please pay only the exact amount specified in the order confirmation and make individual payments per order.
6.4 Price Changes
The prices of the products displayed on the website are subject to change. Toh reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.
6.5 Pricing Errors
Please note that although the website is updated with extreme care, there may be errors in price information on the website. Toh does not commit to the offer and reserves the right to cancel your order in case such an error occurs.
7. Quality and Warranty
Toh does not sell defective products or those of lower quality than the standards in the market. The main features and ingredients of each product shown on toh.pet can be found on each respective product page.
The products offered for sale on toh.pet may not exactly match the actual appearance in terms of images and colors, due to the internet browser and monitor used.
All hygiene products come with a protective pleated paper sheet. Do not remove this protective sheet if you wish to return the purchased product.
If you decide to exercise the right to return the purchased products, Toh has the right not to accept the return of hygiene products that are returned without the protective sheet or that have been altered from their original condition or damaged.
8. Shipping and Delivery
8.1 Delivery: Where and When
We deliver products from Monday to Friday, from 9 am to 6 pm. We do not ship on certain holidays. We can only fulfill delivery of an order if the delivery address is a home or office located in one of the countries listed in the delivery country menu.
To receive the order, ensure that someone is at the address. This service does not include the option of scheduling or appointment setting, so the delivery will be made without prior contact from the carrier. We do not guarantee this timeline during promotions, sales, Christmas, epidemic periods, or in case of stock shortages.
A delivery is considered made or a product is considered delivered when the receipt is signed at the agreed address.
8.2 Delivery Times
If you confirm your order on a business day before 10 am and make payment by Credit Card or via Paypal, your order will be shipped the next business day (weekends and holidays are not considered business days), with a delivery time of 24 hours from the moment the order is shipped. If you choose payment via Multibanco Reference, shipping is less efficient as we will only ship after receiving payment, which may take 5 to 7 days.
Toh will not be responsible for non-performance, or delay in performance, of any obligation due to a force majeure event, which refers to any occurrence, act, or omission beyond its reasonable control (Force Majeure Event - which includes any occurrence, act, or omission outside Toh's reasonable control).
We will try to deliver on time as commercially reasonable, but we cannot guarantee timely delivery.
8.3 Partial Deliveries
Whenever possible, we will attempt to deliver everything in a single shipment. However, we reserve the right to split the delivery of the order, for example (but not limited to) if part of the order is delayed or unavailable. In cases where we split the order, the customer will be notified by email of our intention to proceed in this way, using the email address provided at the time of purchase.
8.4 Inspection at Delivery
At the time of delivery, the customer should inspect the packaging for any damage. If you find that the products are damaged, do not accept the delivery of the order, which will be returned. Toh will refund the amounts paid for the order and shipping once the warehouse receives and completes the return process.
Any claim of non-receipt of an order must be made within 30 days from the order date. After this period, Toh cannot be held responsible for its loss.
9. Shipping Fees
9.1 Shipping fees are applied per order. The exact price of each shipment depends on the delivery country. For more details on shipping costs by country, please refer to the Delivery menu on the website.
9.2 Free Shipping
If the customer places an order that exceeds the minimum order value set for their country or campaign, the shipping will be free of charge.
10. Returns
10.1 Order Cancellation Before Shipping
The customer can cancel the order as long as it has not yet been shipped. If the customer wishes to cancel an order, they should contact our Customer Service and request cancellation via the email address hello@toh.pet.
If the cancellation request is successful, the customer will be notified by email and the cancellation will be processed at no cost to the customer. If cancellation is not possible, the products will be shipped to the customer, who, if they still wish to cancel the order, should refuse to receive them. The products will be returned, and once received, the refund will be processed.
10.2 Return of Defective Products
The customer has the right to return delivered products if they are found to be defective or otherwise non-compliant with the ordered items. Returns can be made within 30 days of receiving the order. This does not affect your statutory rights. If your claim is justified, the price and shipping costs will be refunded. For more information on how to return products and refund information, please refer to the Help/FAQ menu on the website.
10.3 Return of Products for Withdrawal
If, for any reason, you are not satisfied with the products you ordered, you can return them within 30 calendar days after receipt, provided that:
The products have not been used;
The product maintains its original characteristics and the packaging is not damaged (carefully opened packaging will not be considered damaged);
You cannot return:
Products that have been altered;
Hygiene products that have been used.
10.4 Return of Gifts
Currently, a person who received a product as a gift from another person cannot return it. In this case, to return the item, the buyer should contact the person who purchased it and request the return according to the Return Conditions.
10.5 Exchange of Products or Sizes
To exchange an item for another or to exchange sizes, please follow the steps in Returns.
10.6 Return Information
If the customer wishes to return items, Toh will cover the shipping and return costs for all orders.
Refunds will be made based on the payment method. If the customer paid via bank reference, they will need to provide their bank details to our Customer Service when initiating the return process. This information is required so that we can refund the money to their account. The customer will receive the refund after the product(s) have been returned and processed.

12. Conditions for Promotional Codes (Discounts)
12.1 When used in accordance with the established rules, a promotional code entitles the user to a promotion/discount on the purchase of a specific product or set of products during the period indicated/associated with the promotional code/campaign.
12.2 Promotional codes can only be used for online purchases made on the website. The sale, exchange, or donation of a promotional code is not permitted. The customer holding the promotional code may not upload or offer a promotional code on any website or public forum for the purpose of offering, donating, selling, or exchanging it. Promotional codes may not be used for commercial purposes.
12.3 The promotional code is associated with the Toh brand. It is not allowed to use the promotional code in connection with another brand, company, or name. The use of the promotional code in an illegal, abusive, or disrespectful manner, or in any other way that could damage Toh's reputation, is also prohibited.
12.4 The use of the promotional code is limited to one use per product and per order. Promotional codes cannot be combined with other promotions or special offers.
12.5 Promotional codes are not exchangeable for cash.
12.6 Toh has no obligation to reissue or refund promotional codes. However, if Toh decides to reissue or refund a promotional code, it must have access to the original promotional code. Therefore, it is necessary to keep a copy of your promotional code, as it cannot be reissued or replaced if lost.
12.7 In cases where Toh reissues/refunds the promotional code, the discount value can only be applied to a purchase equal to or greater than the original purchase where the discount/promotional code was issued.
12.8 Without prejudice to any other rights, Toh may have the right to immediately invalidate the promotional code if Toh suspects that a promotional code is being used: in violation of the above assumptions, through usurpation, or in any other case where Toh has reasons to take such action.
13. Availability
The fulfillment of all orders placed on the website is subject to availability. Toh strives to ensure that all items listed for sale on the website are in stock. However, Toh reserves the right not to accept any orders or cancel already confirmed orders for products that are out of stock. In such cases, Toh will inform the customer and process a refund of the amount paid.
14. Promotion Validity
The offers on the website are valid only for the moment they are displayed on the website, unless otherwise stated on the website. Toh is not bound by any offer if there are spelling, pricing, or other errors on the information provided on the website. Toh reserves the right to cancel any purchase and sale made under such errors.
15. Responsibility
15.1 Toh is only responsible for damages suffered by the customer if such damages result from breaches of Toh's contractual obligations to the customer or if Toh's responsibility results from applicable legal rights.
15.2 If the customer suffers damages related to the website's activity, Toh's liability will be limited to:
Damages to Toh products or other materials;
Reasonable and verifiable costs incurred by the customer to determine the cause and amount of compensation for the damage;
The maximum refund for the above compensation will be (if applicable) the price of the affected products.
15.3 Toh will not be held liable for damages suffered by third parties resulting from the use of any of our products. Toh will not be held liable for damages suffered by the customer as a result of improper use of our products.
15.4 Toh is not responsible for damages resulting from incorrect information on the website.
15.5 In case the customer suffers damages resulting from gross negligence or intentional misconduct by Toh, none of the limitations stated in this article apply.
16. Applicable Law
These general terms and all disputes related to these terms, including their validity, the use of the website, or any purchase made on it, will be governed by Portuguese law.
17. Changes to Terms & Conditions
Toh has the right to change these Terms & Conditions at any time. The customer is subject to the terms and conditions in effect at the time of their order unless the law or competent authority requires changes.
18. Website Information
Although Toh works carefully on its website, the information, texts, documents, graphics, movies, music, and/or other services may contain errors or be incomplete or incorrect.
Toh cannot be held liable for any damages resulting from the use (or inability to use) the website, including damages caused by viruses or any inaccuracies or imperfections in the information unless such damage results from intentional misconduct or negligence by Toh.
19. Trademarks and Copyrights of the Website
All brand names, product names, and titles used on the website are registered trademarks or registered names of Toh or other trademark owners.
The website user/customer is not authorized to use or reproduce any of these registered trademarks or names, as this constitutes a violation of the rights of the holders.
All design, text, documents, movies, music, and/or other services on the website, the selection and organization of the same, as well as the entire compilation of software (including applets) and all other website materials, are the property of Toh and its suppliers.
Users/customers are only authorized to electronically copy and print portions of the website if necessary to place an order or use the website as a source for purchasing.
The user/customer is not authorized to use the website or the information and materials contained on it for any other purpose, including reproduction for purposes other than those mentioned above, modification, distribution, or republication.
20. Alternative Dispute Resolution
Alternative dispute resolution is the possibility that all consumers have to turn to official entities to help resolve or guide them in a conflict.
